Terms of Sale/ Return Policy for Body Kit Parts:

USE OF WEBSITE
By entering our web site, you agree to comply with the terms and conditions set forth below. If you do not wish to be bounded by these terms and conditions, you may not access, use or purchase from this site either online or by phone.

If you submit an order online and have checked the box stating that you have read and agreed to our Terms and Conditions of Sale, you are agreeing to be bound by these terms. If you do not agree to these terms and conditions, you must not submit or finalize your order, and you may not access, use or purchase from this site either online or by phone.

Our products are advertised for sale exclusively online. Our terms and conditions are posted conspicuously - if you place your order by phone you are also agreeing to be bound by these terms and conditions. If you do not agree to these terms and conditions, you must not place your order and you may not access, use or purchase from this site either online or by phone.

Responsibility of Purchaser
Customer is responsible for selecting the correct part number for their vehicle. We assume no liability or incidental costs incurred for wrong parts purchased.

All products sold on this web site are strongly recommended to be installed by professionals in automotive trade that are experienced in installing the particular product that they purchase.

Anyone who purchases from this site, including consumers, re-sellers or installers, are accepting responsibility for the proper installation of these products. Consumers are advised to use an installer that warrants their labor against improper installation.

Payments
All items must be prepaid prior to shipping, we do not ship C.O.D.

We accept payments by Money Order or Credit Cards (no international credit cards).

We can ship to different addresses if paid by Money Order.

**Billing Addresses for Credit Card Payments**
We require your official billing address listed on file with your credit card company in order to obtain an authorization to complete your order even if you ship to a different address.

**Shipping to Different Addresses**
Body Kit parts can only be shipped to an address that is on account with your credit card company.

To ship to a body shop address or a different address, you must add that address to your credit card account as an authorized alternate shipping address. You can call your credit card company and ask them to add an alternate or temporary shipping address to your account for the transaction. (Adding this temporary address will not change your official address, it will only give your bank notice that you are authorizing a shipment to an alternate address.)

Once we verify your alternate address with your credit card company, we will be able to obtain an authorization to charge your credit card.

Cancellations/ Refusals/ Re-Deliveries
CANCELLATIONS after processing your order, if allowed, are subject to a cancellation fee similar to restocking charges if the order has not shipped.

If your order has shipped before notice of cancellation, shipping charges will not be refunded and you will need to request a return and obtain a Return Authorization Number, if the return is allowed as described under "Returns" below.

Refused Deliveries/ Re-Directed Shipments
Refused merchandise at time of delivery will incur return freight charges in addition to cancellation or restocking fees.

Customer is responsible for all charges associated with re-directed shipments.

Product Inspection
It is the customer's responsibility to open the package and inspect the items upon delivery. Packages that appear to be damaged should be immediately reported to the freight carrier. Damage due to shipping is the sole responsibility of the freight carrier. All claims are to be made by the customer directly with the carrier. Shipping carriers will not honor late claims.

Installation Requirements
Buyer is responsible for all fees concerning installation of the product.

All body kit products are manufactured with fiberglass unless otherwise noted. Due to the material used in production, the body kits will NOT be a direct bolt-on. Chips and hairline cracks are normal and may need to be repaired prior to installation - This is normal with fiberglass parts.

Body kits may require prepping, sanding, shaving, filling gaps, cutting, or other extensive body work. These modifications may include removal or cutting of the reinforcement bars.

By complying with our policies, customer understands the procedure and possible difficulty in installing the body kit. We HIGHLY recommend installation be performed by an experienced customizing shop who knows all the procedures of installing fiberglass body kits. We do not recommend a small collision repair shop or factory dealership to installations of body kits. These shops usually are only experienced in installing OEM (factory) parts that are direct bolt-on, and do not know the proper procedures of installing fiberglass body kits. Refunds will not be issued due to poor fitment of the body kit.

Buyer understands that modifications may be necessary in order to get his/her body kit installed properly. If a piece does not fit perfectly, it does not necessarily mean that it is defective. Keep in mind that a part that fits on the same model and year car might not fit your car. Changes in the structure/chassis of your car may affect the fitment of the body kit. A refund will be considered if fitment is off only by extreme margins solely determined by AUTOMEGA®.

USE/LIABILITY
All body kit parts sold by AUTOMEGA® are aftermarket products and are intended for non-road, show use only. AUTOMEGA® is not liable for any damages or injury as a result of your use of these products. Due to strict regulations by the DMV and U.S. Federal and State Safety crash guidelines, some of these products are not approved for street or highway use. AUTOMEGA® will not be responsible or liable for any damage or possible injury incurred due to driver error, incorrect installations, and bad judgment (cracking or breaking your parts). Removal of reinforcements, bumpers, turn signals, and other safety equipment on the vehicle is the responsibility of the buyer. AUTOMEGA® will not be responsible for your actions.

PARTS IMAGES
Please be aware that all cars depicted on the website are highly customized cars. Each car has had many modifications made to them including painting and possibly altering of the depicted kit. Please read the description of the part carefully as one or more of the kit options may include a different part then depicted in the image. The depicted parts may have extra work including, but not limited to, molding, cutting, or adding to the original piece. Parts such as lights, splitters, canards, paint, and others accessories are not included unless specifically specified in the product description.

RETURN POLICY
All sales are FINAL. However, under certain circumstances AUTOMEGA® may allow a return on unused merchandise in like-new condition with a restocking fee, and the customer is responsible for return shipping charges. Original shipping and handling charges are not refundable.

REQUEST FOR AUTHORIZATION
We must be notified of all return claims within 7 days of delivery date of your order. You must call us first to obtain authorization for the return. We will give you instructions on how and where to ship the return. Do not return items without prior authorization. We will not accept shipments to us without a confirmed Return Authorization Number.

Absolutely no returns will be accepted after 30 days.

Items must be returned in its complete new, unused condition for credit.

Package and Insure Items/ Condition of Parts
If you are instructed to ship your return prepaid, the items must be shipped back within 10 days and insured for its full value against loss or damage. Any items shipped freight collect will be refused and returned to you your expense.

All items authorized for return must be carefully packaged in its original carton including all packing material, or in another box that is suitable to protect its contents.

It is important that you insure your package against shipping damage in transit as items returned in scratched or damaged condition will not be credited. If items are damaged in shipment, you will have to make a claim with your shipper to recover the cost of the item.

CREDITS
Items must be returned in its unused condition for credit less the applicable restocking charge. Items that have been painted or not in new, unused condition will not receive credit.

Shipping and Handling charges are services performed and completed at time of original delivery and are non-refundable.

Items returned under warranty will be exchanged or credited at our option. Liability is limited to replacement value of the part only; it does not apply to labor or any indirect or consequential damages.

RESTOCKING CHARGES
Restocking charges are fees incurred for inventory control, administration and handling of returns. Returned Body Kits are subject to a 30% restocking fee.

The AUTOMEGA® web site (www.CustomAutoTrim.com) and the materials therein are provided "AS IS". AUTOMEGA® makes no representations or warranties either express or implied, of any kind with respect to the operation, contents, information, or materials contained therein. You agree that AUTOMEGA®, its directors, officers, employees or other representatives shall not be liable for damages arising from the operation, content or use of the AUTOMEGA® web site. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages.

TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, AUTOMEGA® shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. AUTOMEGA® shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. In any event if your credit card has already been charged for the purchase AUTOMEGA® shall immediately cancel the order and issue a credit.

COPYRIGHTS/TRADEMARKS
All of the contents on this site including graphics, text, logos, button icons, images, audio/video clips and software belongs to AUTOMEGA® and are protected by U.S. and international copyright laws. Any unauthorized use of these materials may be a violation of copyright, trademark and other applicable laws and could result in criminal or civil penalties.

Agreement

All merchandise information presented on our web site was true and correct at the time of publication. AUTOMEGA® may modify this agreement at any time without prior notice, and such modifications shall be effective immediately upon posting of the modified agreement on the site. YOU AGREE TO REVIEW THE AGREEMENT PERIODICALLY TO BE AWARE OF SUCH MODIFICATIONS AND YOUR CONTINUED ACCESS OR USE OF THIS SITE SHALL BE DEEMED YOUR CONCLUSIVE ACCEPTANCE OF THE MODIFIED AGREEMENT.

This agreement shall be governed by, construed, and enforced in accordance with the laws of the State of California. Venue for any action or proceeding arising out of this agreement, or alleged breach thereof, shall be solely in San Diego County, California, within the City of San Diego, California.

SHIPPING DAMAGE/CLAIMS: Commercial freight truck carriers operate differently from standard UPS or FedEx home delivery shipping. Freight truck carriers will not accept claims for damage once you have signed for the package WITHOUT NOTING ANY DAMAGES ON THE DELIVERY TICKET, even if you find damage after you open the box.

It is important that you follow these steps upon delivery to protect your rights to make a damage claim with the carrier:

1. Inspect all contents of packages BEFORE signing for delivery. When you sign for delivery, you are accepting the contents in the condition you have received them, DAMAGED OR NOT, and may waive your right to make a damage claim with the carrier.

2.If your inspection reveals that the CONTENTS are damaged, write "DAMAGED" on the delivery ticket and sign for the package. Notify our Customer Service Dept. immediately at 800-232-6922 and we initiate a damage claim and make arrangements to have a replacement shipped to you. DO NOT REFUSE the shipment. Refusal of shipments WILL INCUR RETURN SHIPPING CHARGES by the shipping company and be CHARGED TO YOU REGARDLESS OF DAMAGE OR NOT. You must write "DAMAGED" on the delivery ticket as a permanent record that you received the item with damage and preserve your rights to make a damage claim.

Trucking companies require a damage claim to be initiated before deciding whether or not to pick up and return the shipment to the manufacturer. In some cases, if the damage is severe they may decide to instruct the receiver to "Field Destroy" the item in lieu of picking up the package.

In the case of MAJOR damage (major cracks or breaks in the part), we may ask for pictures to verify damage. In the instance major damage has occurred, we will file a damage claim and ship you new parts as soon as they are available.

MINOR imperfections, such as small hairline cracks in the primer, small chips in the primer,'box rash' or other minor scratches to the surface can normally be fixed during the prep process before painting the part and may not be warranted under claim for shipping damage.

3.If the BOX appears to be damaged in any way, creased, dented and/or holes, crushed, etc. or appears to have be opened, note that the box was damaged on the delivery ticket and HAVE THE DRIVER SIGN OR INITIAL YOUR NOTATIONS and keep a copy of it. The driver MUST sign or initial the notations that the box was damaged or opened on the delivery ticket in order to PROTECT YOUR RIGHTS to make a future damage claim with the carrier in the case of concealed damage to the contents. IF YOU FIND CONCEALED DAMAGE, YOU MUST REPORT THE DAMAGE TO THE TRUCKING COMPANY WITHIN 5 BUSINESS DAYS OF DELIVERY AND INITIATE A CLAIM.

4.If you accept the package without noting any damages to the box or its contents on the delivery ticket and having the driver sign your notations, you will waive your right to make any future damage claims with the carrier, EVEN IF THE DAMAGE WAS CONCEALED.

5. Once you have signed for the package, ALL DAMAGE CLAIMS MUST BE MADE DIRECTLY WITH THE TRUCKING COMPANY WITHIN 5 BUSINESS DAYS OF DELIVERY. You will find their phone number on your delivery ticket and give them the freight ticket number. Once you have signed for the package, we will not be able to make the claim on your behalf.
